{"id":467,"date":"2021-03-10T07:50:23","date_gmt":"2021-03-10T07:50:23","guid":{"rendered":"http:\/\/www.rnm.in\/blog\/?p=467"},"modified":"2025-01-30T10:55:44","modified_gmt":"2025-01-30T10:55:44","slug":"department-digging-more-information-from-large-taxpayers","status":"publish","type":"post","link":"https:\/\/www.rnm.in\/blog\/department-digging-more-information-from-large-taxpayers\/","title":{"rendered":"Department digging more information from large taxpayers"},"content":{"rendered":"\n<p class=\"has-text-align-center\"><strong>Upcoming Changes in GSTR 1<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If aggregate turnover is more than 5 cr. in preceding\nfinancial year, it is mandatory to report 6 digit HSN code and mandatory\nreporting of all supplies.<\/li>\n\n\n\n<li>If aggregate turnover is upto 5 cr. then minimum 4\ndigit reporting of HSN code and mandatory reporting of all B2B &amp; export\nsupplies (including supplies to SEZ units &amp; deemed exports) and optional\nreporting of HSN code for all the B2C supplies. <\/li>\n\n\n\n<li>Additional column of rate of tax is added in table\nno. 12 thus HSN code details will reported rate wise.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-center\"><strong>Recent\nJudgments<\/strong><\/p>\n\n\n\n<p><strong>Honorable<\/strong>&nbsp;<strong>High\nCourt of Gujarat<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>During search \/\ninspection under section 67 of CGST Act,2017, no recovery can be made by cash ,\ncheque, e payment or adjustment of ITC.<\/li>\n\n\n\n<li>Even if assesse make\nvoluntary payment by filing form DRC-03, the same should be done on the next\nday after the end of search proceedings.<\/li>\n\n\n\n<li>Facility of filing\ngrievance shall be made available to the assesse after the search proceedings\nto address if the assesse was forced to make payment.<\/li>\n\n\n\n<li>If the grievance is filed\nby the assesse and officer is found to have acted in defiance of the\naforestated directions, then strict action shall be initiated against the\nconcerned officer. &nbsp;<\/li>\n<\/ul>\n\n\n\n<p><strong>Appellate Authority for Advance Ruling \u2013\nKarnataka<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Activities of liaison office of foreign company establishing its place of\nbusiness in India are not liable for GST <\/p>\n\n\n\n<p>The foreign company is a \u2018person\u2019 by the virtue of clause (h) of section\n2(84) of the CGST Act. However, the liaison office is not recognized as a\nseparate legal entity in India and is registered with the registrar of company\nin the same name as the parent foreign company. Hence, it doesn\u2019t have a separate\nlegal existence as per law.<\/p>\n\n\n\n<p>Since , the foreign company and its liaison office in India cannot be\ntreated as different persons but as one legal entity, therefore the activities\nof liaison office is in the nature of service rendered to self . The services\nrendered to oneself is outside the purview of \u2018supply\u2019 under GST.<\/p>\n\n\n\n<p>(The activities of liaison office are not a \u2018supply\u2019 under section\n7(1)(a) of the CGST Act and will not be covered under the ambit of clause 2 of\nSchedule I of the Act.<\/p>\n\n\n\n<p><strong>Appellate Authority for Advance Ruling \u2013\nKarnataka<\/strong><\/p>\n\n\n\n<p>Renting of e-bikes\/bicycles without the operator is classified under HSN\n9973 \u2013 Leasing &amp; Renting of Goods.<\/p>\n\n\n\n<p>Renting of e-bikes\/bicycles provides the access of the vehicle to the\nrider. However, there is no transfer of any interest in the vehicle to the rider.\nAs per the terms of agreement, it is seen that the vehicle is always under the\nphysical control of the transferor (i.e. the rider can access the vehicle for\ndesignated time &amp; in the designated area allowed).
