In this edition we have tried to bring to your notice the latest amendments that followed in the month of April 2021 issued by MCA.

Amendments issued by MCA

Companies (Audit and Auditors) Second Amendment Rules, 2021: In exercise of the powers conferred by sections 139, 143, 147 and 148 read with sub-sections (1) and (2) of section 469 of the Companies Act, 2013 (18 of 2013), the Central Government hereby makes the following rules further to amend the Companies (Audit and Auditors) Rules, 2014& these rules may be called the Companies (Audit and Auditors) Second Amendment Rules, 2021&they shall come into force with effect from the 1st day of April, 2021.

Companies (Accounts) Second Amendment Rules, 2021: In exercise of the powers conferred by section 134 read with section 469 of the Companies Act, 2013 (18 of 2013), the Central Government hereby makes the following rules further to amend the Companies (Accounts) Rules, 2014& these rules may be called the Companies (Accounts) Second Amendment Rules, 2021& they shall come into force with effect from the 1st day of April, 2021.

Insolvency and Bankruptcy Code (Amendment) Ordinance, 2021: In exercise of the powers conferred by the second proviso to section 4 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), as amended by the Insolvency and Bankruptcy Code (Amendment) Ordinance, 2021 (3 of 2021), the Central Government hereby specifies ten lakh rupees as the minimum amount of default for the matters relating to the pre-packaged insolvency resolution process of corporate debtor under Chapter III-A of the Code.

Insolvency and Bankruptcy (prepackaged insolvency resolution process) Rules, 2021: In exercise of the powers conferred by sub-section (1) and clause (fd) of sub-section (2) of section 239 read with sub-section (2) of section 54C of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), as amended by the Insolvency and Bankruptcy Code (Amendment) Ordinance, 2021 (3 of 2021), the Central Government hereby makes the following rules, namely Insolvency and Bankruptcy (prepackaged insolvency resolution process) Rules, 2021& they shall come into force on the date of their publication in the Official Gazette.
